Life imprisonment for man in tanod’s murder

Justice has been meted on a neighborhood toughie who was accused of stabbing and slashing the neck of a Virac barangay tanod in 2015.

The Regional Trial Court sentenced Richard Magtangob to suffer the penalty of reclusion perpetua and to pay the heirs of Roberto Ternida the total sum of P192,191.94 in actual damages, civil indemnity, moral and exemplary damages.

RTC Branch 43 Presiding Judge Lelu P. Contreras found the accused’s version of the stabbing incident “incredible”, citing five instances where the facts showed his claim of self-defense could not be sustained.

Records of the case stated that at 5 P.M. of March 1, 2015, Ternida argued with Domingo Valeza, the stepfather of Magtangob.

Despite the warning of Ternida’s daughter that the quarrel was already over and that he was trespassing, Richard entered the yard with a knife hidden at his back.

The tanod tried to hit Richard with a piece of wood but the latter evaded the blow and retaliated by stabbing Roberto on the elbow.

Valeza then held the tanod’s hands while Magtangob repeatedly stabbed Ternida and later slashed his neck. Despite confinement at the provincial hospital, the tanod eventually died three days later from the two wounds on his neck as well as stab wounds on the chest, arm and armpit.

Medico-legal certificates belied the accused’s claim that he was hit on the back of the neck by the poece of wood wielded by Ternida and that he was chocked on the neck.

He likewise alleged that the knife used in the attack belonged to the victim, contrary to a barangay kagawad’s testimony that he saw a knife in Magtangob’s possession before he entered the Ternida yard.

His pointing to Valeza, who remains at large, as the one who slashed Ternida’s neck was likewise belied by a police blotter entry that stated that Magtangob voluntarily surrendered after slashing the tanod’s neck.
